Statutes of Schalke FanClub UK

§ 1 Name and registered office

(1) The fan club is called “Schalke FanClub UK”.
(2) The fan club has its registered office in London, England, and in Gelsenkirchen-Schalke, Germany.
(3) The financial year is the length of the Bundesliga season. The cut-off date is 15 May each year.
(4) The fan club was founded on 26.02.2010.
(5) The club colours are blue and white.
(6) The fan club logo shows the outline of Great Britain with the Schalke club logo.
(7) The fan club flag is the Union Jack in royal blue with the lettering “Schalke FanClub UK”. The logo of FC Schalke 04 is at the top left. The logo of Schalke FanClub UK is at the bottom right.

The use of the fan club logos is only permitted with the consent of Schalke FanClub UK.

§ 2 Purpose of Schalke FanClub UK

The purpose of the fan club is to support FC Gelsenkirchen-Schalke 04 e.V.

(2) In doing so, the fan club opposes all hooliganism and all violence by football fans. We also reject every form of xenophobia and extremism!

(3) The fan club wants to offer everyone around the world who is interested in FC Schalke 04 a platform on which they can exchange views on matters concerning FC Schalke 04. To this end, the fan club uses a mailing list. This mailing list is accessible to members only. All members who do not actively object to this arrangement agree to the use of their personal data.

(4) Because of its membership in the Schalker Fan-Club Verband e.V., the fan club also serves as a link to FC Schalke 04.

(5) In doing so, the fan club pursues exclusively and directly non-profit purposes. The fan club’s funds may only be used for the purposes set out in these statutes.

§ 3 Fan club activities

The fan club fulfils its tasks, for example, by providing access to a mailing list that enables its members to exchange views daily and worldwide.

In addition, at the request of its members, the fan club organises joint events, such as visits to matches of FC Schalke 04, fan meetings, fan club trips, and summer and winter parties.

Schalke FanClub UK helps members in need with interest-free loans and/or material support, where the situation allows, and supports general Schalke relief campaigns with financial donations.

3.1 Ticketing

Fan club members have no entitlement to the allocation of tickets for matches of FC Schalke 04. The allocation criteria are determined solely by the fan club committee, which applies them to the best of its knowledge.

The handling fee for ordered tickets is €1.00 for standing places and €2.00 for seats. This amount is credited to the fan club. For special matches (finals etc.) with very high demand and only a small allocation, the board may set higher handling fees.

The decisive criteria for allocating tickets are: 1. active fan club work, 2. length of membership of the fan club, 3. residence in the UK and 4. membership of FC Schalke 04.

As a general rule for ticket orders: there is only one ticket per match per fan club member. Tickets must be paid for in advance. The tickets are sent by registered mail or online. The fan club gives no guarantee and accepts no liability for lost tickets.

Every person ordering tickets is responsible for ensuring that the fan club has their current address for sending the tickets.

§ 4 Membership of Schalke FanClub UK

(1) Any natural person interested in matters concerning FC Schalke 04 can become a member of the fan club. For persons who do not have full legal capacity, written proof of the consent of their legal representatives is required.

(2) Membership begins by joining the fan club and transferring the membership fee.

(3) Membership must be applied for in writing to the fan club committee.

(4) The fan club committee decides on the application for admission. After the first payment of the membership fee, joining takes effect when a corresponding confirmation email is sent.

(5) The fan club committee’s rejection of an application cannot be contested. There is no legal entitlement to membership.

(6) Membership ends (a) by resignation, (b) by exclusion, (c) by removal from the membership list.

(7) A member can resign from the fan club at any time by a simple written declaration.

(8) Exclusion from the fan club is only permissible for good cause. Good cause exists in particular if a member knowingly gave false personal details when registering. Exclusion also takes place in the event of dishonourable conduct inside or outside the club, in particular by expressing racist or xenophobic views.

(9) A member can be removed from the membership list if the member is more than three months in arrears with payment of the fee. The reminder should point out the intended removal.

(10) The fan club committee decides on exclusion from the fan club. The member must be given the opportunity to comment beforehand. The exclusion takes effect immediately upon the decision. The member must be notified without delay, stating the reason. Notification is given by email to the address the member provided when registering.

(11) In the event of resignation or exclusion from the fan club, overpaid fees are not refunded.

(12) Appointed honorary members can only be excluded from the fan club by the fan club committee because of considerable personal misconduct.

§ 6 Membership fee

The fan club charges membership fees.

The amount of the fee is decided by the fan club committee. The current annual fee from the 2017/2018 season is €15 / £13.

Membership for children under 16 is free of charge from the 2020/21 season.

The fee must be transferred to the account provided or paid via PayPal (plus PayPal fees). The reference date for payment of the fee is 15 May each year.

§ 7 Fan club committee

The fan club is led by active members who take the decisive decisions. These members form the fan club committee. The number of members holding a function on the fan club committee is not limited.

(2) Internal tasks are assigned in agreement with all committee participants for the benefit of the fan club.

(3) Members of the fan club committee must have belonged to the fan club for at least 12 months.

(4) Every active member can apply for an active role on the fan club committee. The fan club committee decides on admission.

(5) The fan club committee can initiate amendments to the statutes if at least 51% of the committee participants agree to the change.

(6) For external representation, a fan club president is appointed. The appointment is made by the fan club committee. The office carries no additional duties, requirements or privileges.

§ 8 Limitation of power of representation

The fan club committee is generally authorised to carry out legal transactions concerning the assets of the fan club. There is no limitation.
